Workplace retaliation occurs when an employer takes adverse action against an employee for engaging in a “protected activity.” These activities include reporting discrimination or harassment, filing a complaint with Human Resources or the Equal Employment Opportunities Commission (EEOC), participating in an internal or external investigation, or asserting your rights under wage, safety, discrimination, or whistleblower laws.

Workplace retaliation can take many forms, including:

  • Termination or forced resignation

  • Reduction in pay or benefits
  • Negative performance evaluations without justification
  • Harassment or intimidation by supervisors or coworkers
  • Unfair scheduling or exclusion from meetings, projects, or opportunities

Employment retaliation is illegal under state and federal law, including Title VII of the Civil Rights Act, the Americans with Disabilities Act, and the Whistleblower Protection Act. But proving employment retaliation can be challenging. Employers rarely admit that an employee was punished for speaking up.
